Once again Chris Soules has avoided being sentenced for leaving the scene of a fatal accident. Sentencing was supposed to be today but the judge has delayed it yet again. The family of the victim have written letters to the judge to impose the maximum 2 years in prison for Chris, but the judge says he has disregarded their pleas because Chris was not convicted of causing the man's death. This case is really being dragged on.

I heard about the sentencing scheduled for today but not much about it.  The wheels of justice turn slowly.  

I think the time delays in this case are probably not uncommon.

I just saw another article that said Chris and his parents had to pay $2.5 million in a wrongful death suit for the death of the man. This accident has sure put a stain on the Soules family. Such a small community. i wondered how the man's family would deal with this and it sounds like they have gone after them.

Thanks for the information, Mule.  I did not know they had a wrongful death suit.  I haven't been following the case lately.  But I just read that Chris's attorneys made a motion for a new presentence investigation report to be written and that's why sentencing was delayed.  One of Chris's attorneys estimated that the new report will be completed in the summer and that a new hearing date for sentencing could be in August.    Sure.  I think that will be delayed as well.

I don't know what a presentence investigation report is or why they need, but ok. Another delay.

I didn't know either lol but I just found out that it is an investigation report into the history of the person who's convicted in order to determine if there are extenuating circumstances to reduce the sentence or if there's a history of criminal behavior to increase the sentence.  There in Iowa, the report includes an assessment of the likelihood of him committing more crimes in the future.    So then the judge has more information that might be relevant to how harsh the sentence should be.

After Chris's attorneys made the motion for a new presentence investigation report/PSIR to be written, the prosecution actually agreed with the motion, saying that the PSIR relied on the victim impact statements which have since been stricken.  I don't know why the impact statements were removed from the record.  The prosecution also said that their recommendation as to sentencing was based on that PSIR, so they didn't oppose the defendant's motion.
